What Is the 'Regular Rate of Pay'?

The regular rate is not simply your hourly rate — it’s a legally defined rate that includes all remuneration for employment paid in the workweek, divided by the total hours worked that week. Most additional compensation must be included in the regular rate calculation.

What’s Included vs. Excluded from the Regular Rate

What’s included vs. excluded from the FLSA regular rate of pay

Non-discretionary bonusesTruly discretionary bonuses

Production bonusesContributions to pension/retirement plans

Step-by-Step: Regular Rate Calculation With Bonus

Example: $22/hr, 47 hours in the workweek, plus a $100 non-discretionary production bonus.

  1. Calculate straight-time total: $22 × 47 hours = $1,034
  2. Add bonus: $1,034 + $100 = $1,134
  3. Calculate regular rate: $1,134 ÷ 47 hours = $24.13/hr
  4. Calculate overtime premium (0.5× premium on OT hours): $24.13 × 0.5 × 7 OT hours = $84.46
  5. Total gross pay: $1,134 + $84.46 = $1,218.46
⚠️Most Employers Calculate This Wrong

Many employers calculate overtime BEFORE adding the bonus, then add the bonus separately. This underpays workers. The correct method: include non-discretionary bonuses in the regular rate calculation, then compute the overtime premium on that elevated rate. On a $100 bonus with 7 overtime hours, the difference can be $15–$25 — over a year of weekly bonuses and overtime: hundreds of dollars.

What to Do If Your Employer Under-Calculates Overtime

Document the discrepancy. Calculate the correct amount using the regular rate method. Present your calculation to HR or payroll. Under the FLSA, there’s no time limit on collecting current-year wages and a 2-year statute of limitations on back wages (3 years for willful violations). Filing a complaint with the DOL Wage and Hour Division is free and confidential.
